Rules and Regulations
Chapter I: General Provisions
Article 1 (Name)
This club shall be named MUSCLE GATE Hotel Boutique Gym (hereinafter referred to as "the Club").
Article 2 (Purpose)
The purpose of the Club is to promote the health of its members through sports, foster mutual friendship among members, and contribute to the creation of a healthy and bright community in the local society.
Article 3 (Operation and Management)
The Club shall be operated and managed by U-PROJECT Co., Ltd. (hereinafter referred to as "the Company"), located at 2F Sankyo Chuo Bldg., 3-6-13 Kanda Misaki-cho, Chiyoda-ku, Tokyo.
Chapter II: Membership
Article 4 (Membership System)
The Club operates on a membership system. Members shall enter into an agreement for the specific membership type designated for each branch location upon enrollment, and may use the various facilities in accordance with their scope of access.
The term of a member's contract shall automatically renew until the member completes the prescribed withdrawal procedure specified by the Company.
Article 5 (Membership Categories)
The membership categories of the Club shall be as follows. Requirements, conditions, and scope of access for each category shall be separately determined by the Company. However, honorary memberships may be established in addition to the following:
Individual Member
Corporate Member
Article 6 (Eligibility for Membership)
Individuals eligible for membership must be junior high school graduates or older who agree with the purpose of the Club and accept these T&Cs. The Club reserves the right to approve or reject any application at its sole discretion without the obligation to disclose the reason. The eligibility requirements for joining the Club are as follows:
Must be a junior high school graduate or older and comply with these Terms and Conditions as well as other rules of the Club.
Must not be prohibited from exercising by a physician or medical professional and must declare no hindrance to using the Club's facilities. (Individuals with doubts about their health status should consult in advance. Those aged 65 or older are required to submit a medical certificate).
Must possess the dignity and social credibility appropriate for a member of the Club.
Must not be associated with organized crime (Yakuza) or habitual drug use.
Must not have tattoos or body art.
Must not have been subject to a forced membership termination (expulsion) by the Club in the past.
Article 7 (Enrollment Procedure)
The Company considers an individual a formal member of the Club once they have agreed to these Terms, completed the enrollment procedures, received approval from the Company, and paid the prescribed enrollment registration fee and membership fees.
Article 8 (Handling of Minors)
When a minor wishes to become a member, both the minor and their legal representative (parent/guardian) must jointly sign the application. In this case, the legal representative shall be jointly and severally liable with the applicant for all obligations under these Terms and Conditions.
Article 9 (Membership Card)
The Company shall issue a digital membership card to each member.
Members must follow the prescribed procedures when using the Club's facilities. Members will not be allowed entry without their digital membership card.
Members shall not lend their membership card to any third party. If a member lends their card, the Club may expel said member.
If a digital membership card is lost, the member must immediately notify the Company and reapply for a digital reissue following the prescribed procedures.
The reissuance fee for a digital membership card shall be borne by the member, who must pay 1,100 yen (tax included) to the Club as a reissuance fee.
When a member loses their membership status, the withdrawal process will automatically be executed on the system.
Article 10 (Enrollment Registration Fee, Membership Fees, etc.)
The amount, payment due dates, and payment methods for enrollment registration fees, recurring membership fees, and other charges shall be determined by the Company.
Once paid, the enrollment registration fee shall not be refunded. On the other hand, once paid, recurring membership fees and other charges will be refunded in the event of withdrawal, minus the fees for the month in which the request was made and a handling fee of 1,100 yen (tax included). In this calculation, if a discount was applied for multi-month advance payments, the discount amount will be deducted from the fees of the final month applied for prior to final calculation.
The Company may adjust amounts for enrollment registration fees, membership fees, and other charges if deemed necessary for Club operations or due to economic fluctuations.
Article 11 (Withdrawal)
To withdraw from the Club, a member must complete the prescribed procedures on the system.
If membership fees remain unpaid for a period of time due to member circumstances, it will be treated as a withdrawal.
Any outstanding fee balances must be paid in full upon withdrawal.
Article 12 (Expulsion of Members)
If a member falls under any of the following items, the Company may expel the member, and the member shall forfeit their membership status:
Violation of these Terms and Conditions or other rules of the Club.
Damaging the honor or reputation of the Club, or disrupting public order.
Delinquency in paying membership fees or other debts without responding to reminders from the Company.
Making false statements to the Company at the time of enrollment.
When the Company judges the member to be unsuitable as a member of the Club.
Article 13 (Cancellation by the Company)
If the Company deems a member to be inappropriate for membership, the Company may unilaterally cancel the membership agreement by paying the member an amount equivalent to two months' worth of membership fees.
Article 14 (Loss of Membership Status)
A member shall lose their membership status upon the occurrence of any of the following:
When the member submits a formal withdrawal request (prior notification to the Company is required).
When the member is expelled.
When the membership contract is canceled pursuant to Article 13.
Upon the death of the member.
Upon the dissolution of a corporate entity member.
When the Club is closed due to significant operational reasons.
Article 15 (Change of Membership Plan)
If a member wishes to change their membership category/plan, they must execute the change procedure through the system.
Article 16 (Notification of Changes)
In the event of changes to address, contact details, or other application information, the member shall promptly update their information on the system.
Notifications from the Company shall be sent to the latest address registered by the member, and the Company shall bear no responsibility for any non-receipt resulting from failure to update.
Article 17 (Visitors)
The Club may permit non-members (hereinafter referred to as "Visitors") accompanied by a member, or approved by the Company through prescribed procedures, to use the facilities. In such cases, Visitors must present identification and pay the facility usage fees specified separately.
Article 18 (Compensation for Damages)
As a general rule, members and visitors are personally responsible for any theft or loss occurring during facility use, and the Company assumes no liability.
The Company shall not be liable for any damages incurred by a member during facility use due to reasons attributable to the member. The same applies to Visitors.
If a member causes damage to the Company or a third party due to reasons attributable to the member during facility use, the member shall promptly compensate for such damage. The same applies to Visitors. In the case of Corporate Members, the registered corporate entity shall assume all liabilities.
As a general rule, members and visitors use the facilities at their own risk regarding injuries, illnesses, or accidents (excluding fatal/severe incidents), and the Company assumes no liability. However, if the Company is responsible, compensation shall generally be capped at 150,000 yen (except in cases of intentional misconduct or gross negligence by the Company).
Article 19 (Lost and Found / Left Property)
Members and visitors are personally responsible for loss of property during facility use, and the Company assumes no liability.
In principle, lost or left items cannot be stored or held, as this is an unattended gym.
Article 20 (Revision of Terms and Other Regulations)
When deemed necessary, the Company may revise these Terms and Conditions, bylaws, facility regulations, and other administrative matters. When implementing revisions, the Company shall post a notification on its official website at least one month in advance, and the revised terms shall apply to all members thereafter.
Article 21 (Closure and Dissolution)
The Company may close or dissolve the Club if deemed necessary. In such cases, membership fees and other charges for the months following the closure or dissolution will be refunded. (For multi-month advance payments, the remaining balance minus fees up to the month of closure/dissolution will be refunded). However, the Company will endeavor to arrange alternative facility access at nearby partner clubs whenever possible.
During facility renovation or repair work.
When conducting special activities or events organized by the Club.
When operations become impossible due to natural disasters, acts of God, or other force majeure events.
When there are major operational or business reasons.
Chapter III: Facility Use
Article 22 (Strict Compliance with Regulations)
Members must strictly observe these Terms and Conditions as well as other rules established by the Company when using the Club's facilities.
Article 23 (Health Management)
Members and visitors shall manage their own health under their own responsibility.
Article 24 (Denial of Entry and Eviction)
The Company may prohibit entry or order the eviction of any member or visitor who falls under any of the following:
Suffering from an infectious disease.
Deemed unsuitable for exercise due to compromised health conditions.
Filming or photographing inside the facilities without permission.
Engaging in unauthorized commercial activities, sales, personal training, or solicitations inside the Club.
Defaming or slandering others.
Acts of violence or intimidation against others.
Acts contrary to public order and morals, such as molestation, voyeurism, or indecent exposure.
Vandalizing, graffitiing, or altering facility structures.
Bringing animals into the facilities (guide dogs excluded).
Bringing hazardous materials into the facilities.
Entering under the influence of alcohol, or drinking/smoking inside the facilities.
Interfering with the duties of Company or hotel employees.
Stalking others.
Disrupting or obstructing facility usage by others.
Making false declarations upon entry.
Any other acts equivalent to the preceding items.
Article 25 (Temporary Closures)
In addition to regular scheduled closed days determined separately by the Company, the Club may temporarily close for facility maintenance or due to unavoidable circumstances. Notice of temporary closures will be posted inside the facility in advance.
